١. القبول1. Acceptance

باستخدامك «مقاولون» (التطبيق والموقع) فإنك توافق على هذه الشروط وعلى سياسة الخصوصية. إن لم توافق فلا تستخدم الخدمة. الخدمة لمن عمره ١٨ سنة فأكثر.

By using Moqawelon (the app and the website) you accept these terms and the privacy policy. If you do not accept them, do not use the service. The service is for people aged 18 and over.

٢. ما هي الخدمة2. What the service is

أداة تساعد المقاول وفريقه وعملاءه على تنظيم المشاريع ومتابعتها: التقدم والدفعات والفواتير والمخططات والعقود والموافقات والمحادثات. تقدّمها Spacetech-KW في الكويت.

A tool that helps contractors, their teams and their clients organise and follow building projects: progress, payments, bills, plans, contracts, approvals and chat. It is provided by Spacetech-KW in Kuwait.

نحن لسنا طرفاً في العقد أو الاتفاق بين المقاول والعميل، ولا نضمن تنفيذ العمل أو جودته أو سداد الدفعات. المسؤولية عن الاتفاق وتنفيذه على المقاول والعميل.

We are not a party to the contract or agreement between a contractor and a client, and we do not guarantee the work, its quality or any payment. The agreement and its performance are the responsibility of the contractor and the client.

٣. الحساب3. Your account

أعطِ معلومات صحيحة، واحفظ كلمة المرور سرية، وأنت مسؤول عما يتم بحسابك.
إن شككت في اختراق حسابك فبلّغنا فوراً وغيّر كلمة المرور.
يمكنك حذف حسابك في أي وقت من التطبيق (المزيد ← حذف حسابي).

Give correct information and keep your password secret. You are responsible for what happens under your account.
If you think your account was broken into, tell us at once and change your password.
You can delete your account at any time in the app (More → Delete my account).

٤. المحتوى الذي ترفعه4. Content you upload

تبقى ملكية المحتوى الذي ترفعه (صور، عقود، مخططات، رسائل ...) لك أو لصاحبه. تمنحنا فقط الإذن بحفظه وعرضه للأشخاص الذين تحدّدهم داخل الخدمة وبالقدر اللازم لتشغيلها. تتعهّد بأن لك الحق في رفعه وأنه لا ينتهك حقوق الآخرين ولا القانون.

You keep the ownership of the content you upload (photos, contracts, plans, messages ...), or it stays with its owner. You only give us permission to store it and show it to the people you choose inside the service, as far as needed to run it. You promise you have the right to upload it and that it does not break anyone's rights or the law.

لا ترفع هوية أي شخص أو بياناته الشخصية إلا بموافقته.

كل ملف يُرفع يُفحص أمنياً، ونرفض الملفات التي تحتوي على أكواد أو برامج أو وحدات ماكرو، ونحذفها. يحق للمشرفين المعتمدين الاطلاع على المحتوى لأغراض الأمان ومكافحة الإساءة والمراقبة، مع تسجيل كل اطلاع.

Do not upload anyone's ID or personal data without that person's consent.

Every uploaded file is safety-checked. We refuse and delete files that contain scripts, programs or macros. Authorised administrators may read content for security, abuse handling and monitoring; every access is logged.

٥. الاستخدام المقبول5. Acceptable use

يُمنع: محاولة الدخول إلى بيانات غيرك، أو تعطيل الخدمة، أو إرسال برمجيات خبيثة، أو الإساءة والتحرش، أو رفع محتوى غير قانوني، أو انتحال هوية شخص أو شركة، أو نسخ الخدمة أو هندستها عكسياً، أو استخدام الخدمة لغير غرضها.

Not allowed: trying to reach other people's data, disturbing the service, sending malware, abuse or harassment, illegal content, pretending to be a person or company, copying or reverse-engineering the service, or using it for anything other than its purpose.

٦. الموافقات والسجلات6. Approvals and records

يسجّل التطبيق قرارات العميل على طلبات التغيير مع الوقت وعنوان الشبكة ونوع الجهاز، ويختم السجل لإثبات ما تم. هذه السجلات أداة توثيق ولا تُعد استشارة قانونية. الأثر القانوني لها يخضع لقوانين دولة الكويت.

The app records the client's decisions on change requests with the time, the network address and the device type, and seals the record as proof of what happened. These records are a documentation tool and not legal advice. Their legal effect is governed by the laws of the State of Kuwait.

٧. التوفر والتغيير7. Availability and changes

نبذل جهدنا لتعمل الخدمة بشكل مستمر، لكن قد تتوقف أحياناً للصيانة أو لأسباب خارجة عن إرادتنا. قد نغيّر الخدمة أو نضيف إليها أو نوقف جزءاً منها. سنحاول إخبارك قبل أي تغيير مهم.

We work to keep the service running, but it may stop at times for maintenance or for reasons outside our control. We may change, add to or stop parts of the service. We will try to tell you before an important change.

٨. حدود المسؤولية8. Limits of liability

تُقدَّم الخدمة «كما هي». في أقصى حد يسمح به القانون لا تتحمل Spacetech-KW مسؤولية الخسائر غير المباشرة أو الضياع في الأرباح أو البيانات الناتج عن استخدام الخدمة أو عدم القدرة على استخدامها، ولا النزاعات بين المقاول والعميل. لا يؤثر ذلك على أي حق لا يجوز التنازل عنه بحكم القانون. يُنصح بالاحتفاظ بنسخة من مستنداتك المهمة.

The service is provided "as is". As far as the law allows, Spacetech-KW is not liable for indirect loss, lost profit or lost data from using or not being able to use the service, nor for disputes between a contractor and a client. This does not affect any right that cannot be waived by law. Keep a copy of your important documents.

٩. الملكية الفكرية9. Intellectual property

١٠. إيقاف الحساب10. Ending an account

يمكنك التوقف في أي وقت وحذف حسابك. ويحق لنا إيقاف حساب يخالف هذه الشروط أو يعرّض الخدمة أو غيره للخطر.

You can stop at any time and delete your account. We may suspend an account that breaks these terms or puts the service or others at risk.

١١. القانون والاختصاص11. Law and courts

تخضع هذه الشروط لقوانين دولة الكويت، وتختص محاكمها بالنظر في أي نزاع، دون الإخلال بحقوقك النظامية كمستخدم.

These terms are governed by the laws of the State of Kuwait and its courts decide any dispute, without affecting your statutory rights as a user.
